一、租赁期间，乙方除支付甲方的设备租赁费用之外。其他所有配件费用、燃油费、维修费用、来回拖车费、看车费等全部费用由甲方承担。

二、租金付款方式

两条路修整路基费用共贰万元(￥20_0.00元)人民币。机械到达施工现场后乙方先向甲方支付人民币贰仟元(￥20_.00元);甲方修整完1.8公里路基后，乙方再向甲方支付人民币伍仟元整(￥5000.00元);甲方进入另一条路开始修整路基乙方再向甲方支付人民币贰仟元(￥20_.00元);甲方修整完全部路基后，乙方一次性付清剩下壹万壹仟元(￥11000.00元)给甲方。

三、施工要求及工期

1、按该路现状路宽进行路基修整施工，另增加四个避车道。

2、工期为25天，即从20_年8月22日-20_年9月18日止。

四、租赁期间甲方随机操作人员必须服从乙方现场施工人员的安排和指挥，尽职尽责，未经乙方同意不得擅自离岗，但乙方不得强令操作人员违章冒险作业，如因此造成事故，乙方应负全责。甲方操作人员因自身操作不当，造成事故，甲方应负全责。

五、甲方工程完工后，应提前通知乙方现场验收，作好退场准备。

六、违约责任

(一)甲方违约责任

1、甲方因使用管理不当，强令违章冒险作业，擅自拆卸等原因，造成所租机械的损坏、损失，甲方自己负全部责任。

2、甲方擅自将机械转租或擅自安排未经乙方同意的人员上机操作所造成机械事故，或利用机械进行非法活动，由此给乙方造成的经济损失或其他损失的，甲方应予赔偿，同时乙方有权解除合同。

3、如甲方中途退出不按合同修整完路基，乙方有权不支付给甲方剩余款项。

4、挖掘机在运输过程中发生任何安全事故，甲方负全部责任，与乙方无关。

七、本合同未尽事宜，经双方共同协商作出补充规定，补充规定与本合同具有同等法律效力，双方在履行本合同的过程中若发生争议，可自行协商解决，若协商不成可以申请仲裁。

八、 本合同一式贰份，双方各执壹份，经双方代表签字生效。工程完工且剩余款项全部结清后，本合同自然失效。

2、甲方应对其在施工场地的工作人员进行安全教育，并对他们的安全负责。甲方不得要求乙方违反安全管理的规定进行施工。

未尽事宜双方另行协商解决，本协议一式三份，甲方执两份，乙方执一份，双方签字后生效。

为了确保挖机在租赁过程中正常运行，经甲乙双方就挖机租赁有关事宜进行协商，特签本合同。

一、 甲方的权利和义务

月度租赁作业工时为270小时，如因甲方原因或者无作业任务等，乙方作业工时不足270小时，乙方的租赁费不变：如作业工时超出小时以上的部分，甲方按每小时130元的标准再支付乙方的超时作业款。计时方式为挖机电脑计时，月度到期之日开具完工单。

四、进退场费用规定

甲方租赁乙方挖机期限不足2个月的，进场费用由甲方承付，达到2个月的进出场费由乙方支付。

五、租金标准

合同宗旨为月度租赁，即每月(三十天)挖机的基本租赁使用费为33000元整。

六、租赁费用的支付

挖机自进场之日起每月租赁时间达到25天后一次性付清当月租金。

七、安全责任及设备保管

1、甲方必须提供安全的施工环境，正确指挥施工，如乙方觉得施工环境太差，工作难度太大，作业很不安全，可停止施工，待消除不安全因素后再施工。如甲方强行施工，造成设备及人员伤亡，甲方全部承担赔付。

2、如出现甲乙双方事先没有预测的事故发生，造成设备损坏和人员伤亡，由甲乙双方共同协商处理。

3、属乙方挖机手责任，造成设备损坏和人员伤亡有乙方承担责任。

4、乙方责任人员必须听从安排，积极、主动配合甲方责任人员的指挥，优质高效完成每天的工作，并遵守甲方的作用时间和规章制度。

八、综上所诉，甲乙双方互相遵守，确保施工正常进行。本合同一式两份，甲乙双方各执一份，自签字之日起生效，每份都具有同等法律效力。

6.付款：Payment:

承租人付给出租人的全部租金分两次支付，每一次于货到目的港日算起6个月后支付；第二次于货到目的港日算起12个月后支付。全部租金以美元支付，电汇出租人××银行或出租人临时指定的银行。交货后，无论承租人是否使用了商品，包括因不可抗力事故，均须按上述条件向出租人支付租金。

10.税费：Taxes:

11. 使用商品权：

Right of Using the Commodity:

除了承租人以外，任何人不经出租人书面同意，不得使用该商品。

Nobody except the Leasee may use the commodity, but the Leasee shall not allow any other person to use the commodity without the Leasor's prior written consent.



12.保证： Guarantee:

承租人在签约后，但必须在装运期一个月前，向出租人提交 中国银行出具的以出租人为受益人的保证函，作为承租人履行本协议全部义务的保证金。

The Leasee shall furnish the Leasor, on/after the signing of this agreement but not later than one month prior to the date of the shipment of the commodity stated herein, with a letter of guarantee issued by Bank of China, ______in favour of the Leasor as the secruity of full execution of the Leasee's obligations under this agreement.



13.延期付款的罚金：Default Interest:

若承租人未按期付款，则必须向出租人交纳延期款项的罚金，年率为×%，时间从付款到期日计算至实际付款日期。

In case the Leasee is in default of any payment herein,the Leasee shall pay the Leasor a default interest on the amount delayed at the rate of ____% per annum as from the date when the payment is due to the date of actual payment.



14.维修：Maintenance:

承租人必须自负费用维持商品的良好状况；但是出租人必须对商品的故障负责，承租人有权想出租人提出赔偿因此所遭受的损失。

15.有效期限：Duration:

16.适用法律： Governing Law:

本协议的签订、解释和履行受中华人民共和国法律制约。兹证明，双方在以上开首语中书明的日期签署盖章。本协议以英文书写，一式两份，每放各执一份。
